Fun Comp Inc. (“Fun Comp”, “we”, “our” or “us”) is a mobile application “app” developed to present, offer and facilitate skilled based Contests, Competitions, Tournaments, Games (also referred to in totality as “Games”) for mobile devices. We also operate the www.funcomp.com website, its subdomains and its related features (“Website”, and together with the Apps – the “Services”).
Fun Comp offers Timed Games of Skill in several areas including but not limited to Math, Trivia, Spelling, Drawing, Singing, Reading, Dancing & more. The first 10 participants that submit the correct answer or correct submission within a certain time period are considered the winners and awarded the appropriate prize based on the timestamp of the individual user’s correct answer or correct submission. Fun Comp does not offer gambling, lotteries or sweepstakes.
Fun Comp is committed to protecting the privacy of its users (“users”, “you" or “your”). This Privacy Policy has been created to inform you about how Fun Comp manages, collects, stores and uses the information you provide in connection with any Fun Comp game or application ("Service"). Please note that the scope of this Privacy Policy is limited only to information collected by Fun Comp through your use of a Service.
You are not obligated to share any personal or non personal information with Fun Comp. You agree that you understand that you are not obligated to use our Services and you are entering into a binding contract when you install and participate in our Services.
You should read, make sure you fully understand and agree to this Policy. If you do not understand and agree to this Policy, you should not start to use our Services or you should immediately discontinue using our Services. You agree that you accept and fully understand this Policy and usage or continuing to use our Services binds you to this Policy and waives your right to enter into any Class Action Lawsuit against Fun Comp or it’s partners.
By using the Services, you agree to the collection and use of your personal information and non personal information as outlined in this Privacy Policy. Fun Comp may amend our Privacy Policy from time to time, and Fun Comp encourages you to consult the Privacy Policy regularly for changes.

1) Acceptance of Privacy Policy
You are reading and accepting a legal and binding agreement between Fun Comp Inc. (“Fun Comp”) and yourself (“you”). By accessing or using any Fun Comp application or games (“Privacy Policy”) you agree that you have read fully, fully or partially understood, had or not had legal representation and you fully accept and agree to be bound by all of these Privacy Policies above and below.
2) Information Collected
Fun Comp' primary objective in collecting user information is solely to provide and enhance the Services and to enable users to enjoy the Services.
When you install any of the Services, Fun Comp may collect and record the information you provide to Fun Comp, whether through the Services or through social network or other third party services ("Account Information").
3) Personal Information
“Personal information” means information about you that can be used to contact or identify you. The personal information types collected in accordance with a Service may vary depending on the activity and may include:
Your name;
Your social networks or third party service user identification number;
Your mobile device’s unique identifier (UDID);
Transaction identifiers for purchases;
Your email address;
Your profile picture;
Your profile video; or
Any other relevant information included in your application, social network or other online profile.
Additionally, Fun Comp may acquire information from you through:
Your access and participation in message boards on a Service;
The contents of your Customer Support requests; or
Your purchase of a virtual product of any type.
Please note that because a third party site manages the purchases of virtual goods offered by the Service, Fun Comp does not have access to your credit card details or billing information.
4) Non-Personal Information
“Non-personal information” is information that, when taken alone, cannot be used to identify or contact you. Fun Comp may collect non-personal information about your use of its Service both in the course of game play and software usage. Fun Comp may also invite you to share non-personal information about yourself which may include but is not limited to:
Your age or date of birth;
Your gender;
Information about the hardware you may own;
Your favorite websites, friend information and fan pages; or
Any other information included in your application, social network or other online profile.
If non-Personal Information is collected for an activity that also requires personal information, Fun Comp may combine your non-personal information with your personal information in an attempt to provide you with a better user experience, to improve the value and quality of the Services and to analyze how its Services are used. The Service may also record game play information such as your game session duration or your high scores.
In addition to information collected as described above, you may choose to share additional information about yourself throughout the Service, such as on message boards and in games. Any actions you perform with other players are considered public, and are in your sole discretion.
Other information Fun Comp may collect includes your occupation, language, zip code, area code, location, and the time zone where a Service is used, as well as information about your computer, mobile device, software, platform, incident data, Internet Protocol (IP) address, network Media Access Control (MAC) address and connection, browser type, browser language, referring pages, exit pages and URLs, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, and the date and time of this activity, so that Fun Comp can better understand customer behavior and improve its products, services, and advertising. Fun Comp may also receive either non-personal or public information from third parties in connection with market and demographic studies and/or data that Fun Comp may use to supplement personal information provided directly by you.
5) Permission To Access Your Device Microphone, Camera and Media Gallery for Game Play and Identification
By using this service you agree to grant Fun Comp access to your Microphone, Camera and Media Gallery for the sole purpose giving yourself the ability to upload a profile image, profile video AND access, upload and submit answers for the Games, Contests and Challenges that require answers to be submitted with an image, video or audio AND for you to submit additional identification when necessary. Your Submissions will be stored to properly provide our Services.

PHOTO GALLERY ACCESS & USAGE PERMISSION is needed so you can, upload and submit answers for the Games, Contest and Challenges that require the users answer to be submitted with an image, video or audio file. Fun Comp may also need access to your camera for you to provide additional identification when necessary. Your Submissions will be stored to properly provide our Services.
GAME CHALLENGE CATEGORIES & ANSWER SUBMISSION TYPES
Fun Comp offers several Game Challenge Categories like Trivia, Math, Spelling, Drawing, Speaking, Singing, Dancing, and more, that will require Answer Submission in the form of Text, Single Choice Check Box, Multiple Choice Check Box, Image Upload, Video Upload, Audio Upload, Video with Audio Upload or Image with Audio Upload.
For example: A host may sing a song while playing a melody on a guitar. The Game Challenge would be for you to learn the song, guitar melody and then send in a video recording of yourself singing the song while playing the melody on a guitar.
Games that require Image Upload, Video Upload, Audio Upload, Video with Audio Upload or Image with Audio Upload need permission or access your Camera, Photo Gallery & Microphone.
PROFILE IMAGE & PROFILE VIDEO
Fun Comp offers the ability for some users to upload a profile Image and Profile Video. Your Profile Image and Profile Video requires access to your Camera, Photo Gallery & Microphone. Your Submissions will be stored to properly provide our Services.
6) How Fun Comp Uses Your Information
Fun Comp uses your information to fulfill your specific requests, purchase orders and to send you purchase confirmation and other account-related information. In addition, the personal information you provide will allow Fun Comp to send you messages regarding, among other things, new products, features, enhancements, special offers, upgrade opportunities, contests and events of interest. You may also later opt out of certain of these communications. You may opt out of all communications from Fun Comp by sending an e-mail to: fcaccounthelp@funcomp.com
Fun Comp may also use personal and non-personal information, both individually and combined together, to better understand the behavior and preferences of its customers, to troubleshoot technical problems, to serve static and dynamic advertising, to enforce its Terms of Service, to ensure proper functioning of its products and services as well as to help improve Services and their content. In addition, Fun Comp may combine non-personal information with personal information, such as an email address, to administer loyalty programs, tailor its offerings, web pages or game play experience to you.
By use of friend finder tools whether directly through the Service or through a social network or gaming service, you acknowledge that use of these friend finder tools will help you find your contacts and will also allow your contacts to associate your Service account (and related gaming entitlements, including games played, wagers and coins) with your social networking profile and/or email address. Your resulting friends’ list will be subject to this privacy policy.
If you choose to use a referral service to "tell a friend" about a Service, Fun Comp may ask you for your friend’s name, email address and or phone number. Fun Comp will send your friend an email on your behalf or a text message inviting him or her to visit the relevant site or check out the Service. Fun Comp stores your friend's name, email and or phone number for a short period for the sole purpose of sending this email and or text and for redundancy checking, to be sure that your friend does not receive multiple copies of the same email message. Fun Comp does not keep or use this information for any other purpose.
If you enter into a game, competition, contest, or similar services or promotions, Fun Comp may use the information you provide to administer those programs and notifications. Your participation in games, competitions, tournaments or other online game events is conditional upon you granting Fun Comp permission to collect, use, store, transmit and display publicly statistical data, such as your scores, rankings and achievements, generated through your participation.
In all cases of data access and collection, the information you provide will not be disclosed, rented, loaned, leased, sold, or otherwise voluntarily distributed to unaffiliated third parties and will be used solely for the purpose of providing you with and improving the Service and for any other purpose stated herein. Fun Comp will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that Fun Comp no longer use your information contact Fun Comp at the email address provided in the Contact Us section below. Note that there may be instances where Fun Comp is legally required to retain your information.
7) Access through Social Network Services or Mobile Devices
By accessing the Service through a social network, mobile device or other third party platform or service or by connecting to such a third party network, platform or service via a Service, you are authorizing Fun Comp to collect, store, and use in accordance with this Privacy Policy any and all information that you agreed the social network, mobile device or other third party platform could provide to Fun Comp through the social network/mobile device/third party platform Application Programming Interface (API) based on your settings on the third party social network, mobile device or platform. Your agreement takes place when you connect with the third party network, platform or service via the Service, and/or when you connect with a Service, or “accept” or “allow” (or similar terms) a Service to access your information through a social network, mobile device or other third party platform or service.
Fun Comp may also collect or receive information about you from other Service users who choose to upload their email contacts. This information will be stored by Fun Comp and used primarily to help you and your friends connect.
8) Browser Use
In the ordinary course of Internet activity, certain information may be sent from your browser to third parties such as advertising networks and analytics companies. Fun Comp has no control over the information sent from your browser to those networks or other third parties and recommends that you ensure that your browser settings prevent the disclosure of information you would not like to share.
9) Third Party Service Providers
Fun Comp may employ third party companies and individuals to facilitate its Services, to provide the Services on its behalf, to perform tasks (e.g., without limitation, maintenance services, database management, web analytics, advertising and improvement of the Services) or to assist Fun Comp in analyzing how its Services are used.
From time to time, Fun Comp employs third party contractors to collect personal information on its behalf to provide email delivery, product, prize or promotional fulfillment, contest administration, debit/credit card processing or other services through the Service. When requesting these services, you may be asked to supply your name, mailing address, telephone number and email address to its contractors. Fun Comp may ask some third party contractors, such as credit agencies, data analytics or market research firms, to supplement personal information that you provide to Fun Comp for its own marketing and demographic studies, so that Fun Comp can consistently improve its sites and related advertising to better meet its visitors' needs and preferences. To enrich its understanding of individual customers, Fun Comp may tie this information to the information you provide to it.
10) Third Party Advertisers
We may utilize third parties to either display advertising on our Services or to manage our advertising on other websites or apps. Our third party advertisers may use Tracking Technologies to gather information about your activities on our Services and other websites and apps in order to provide you advertising based upon your browsing activities and interests. Third Party Integrations: Fun Comp allows you to integrate with certain third party services, such as in order to connect your Facebook, Google or Apple account to our Apps or to place purchases, of which you are bound by the terms and conditions and privacy notices of said third parties (e.g., Apple, Google or Facebook) and you agree that you understand and agree to said third parties Terms and Policies. We do not receive or store your passwords for any of these third party services.
11) Marketing and Advertising
Fun Comp may use your Personal Data ourselves or by using our third-party subcontractors for the purpose of providing you with advertising and promotional materials concerning the Services as well as products, services, websites and applications which relate to: (i) affiliated companies or our business partners and affiliates (collectively, “Marketing Affiliates”), which we believe may interest you.
You may at any time decline receiving further marketing offers from us or from our business partners and Marketing Affiliates by contacting us at the email listed below, however we may continue to send you service-related updates and notifications.
12) Tracking
Fun Comp may track and use your location to uphold jurisdiction regulations, to work with 3rd Party Providers, provide relevant advertising, to confirm your identity and to provide it’s listed or unlisted Services. You may select how you wish to be tracked in your device settings. Your location will be stored to properly provide our Services.
Fun Comp may also track your behavior with the Services to improve the quality of Services provided to you.
13) Game Submissions, Competition Submissions, Message Boards, Chat Rooms, Your Public Submissions
Note that certain information you post and communicate through a Service or a third party site or service is public information for which you have no expectation of privacy.
You may choose to disclose information about yourself in the course of contributing user generated content to Fun Comp sites or Services or in its games, competitions, chat rooms, blogs, message boards, user “profiles” for public view or in similar forums on its sites through mobile services and/or through third party sites or services. Information that you disclose in any of these forums is public information, and there is no expectation of privacy or confidentiality.
You should be aware that any personally identifiable information you submit in the course of these public activities can be read, collected, copied, repurposed, redistributed, used by other users at their sole discretion, could be used to send you unsolicited messages or could be used to track your whereabouts. Fun Comp is not responsible for the personally identifiable information you choose to make public in any of these forums and Fun Comp is not responsible for how your public information is used. Fun Comp may use your publicly submitted information for marketing without your consent and you will not receive any compensation for such usage.
If you post a communication, video, image or photo through a Service for public view, you should be aware that these may be viewed, collected, copied and/or used by other users without your consent. Fun Comp is not responsible for the communications, videos, images or photos that you choose to post through a Service. Please see Fun Comp’s Terms of Service at http://www.funcomp.com/termsofuse on this point and for other guidelines about posting content through any Service.
14) Disclosure of Your Personal Information
You understand and agree that Fun Comp may be required to disclose any personal information if required to do so by law or in the belief that such disclosure is reasonably necessary to avoid liability, to comply with legal process, including, but not limited to a subpoena, statute, search warrant, or court order, or to protect the property and rights of Fun Comp or a third party, to protect the safety of the public or any person, or to prevent or stop activity Fun Comp may consider to be, or to pose a risk of being, illegal, unethical or legally actionable. Note that Fun Comp is not required to question or contest the validity of any search warrant, subpoena or other similar governmental request that it may receive.
Fun Comp may also disclose information about you if it determines that such disclosure is reasonably necessary to enforce the Terms of Use and Privacy Polidcy of the Service or to protect its operations or users. Additionally, Fun Comp may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.
15) Cookies
Like many websites, Fun Comp may use "cookies" to collect information. A cookie is a small data file that is transferred to your computer’s hard disk or your mobile device for record-keeping purposes. The Service may send cookies to a computer or a mobile device when a user accesses or views a Service. Information contained in a cookie may be linked to personal information for purposes such as improving the quality of Fun Comp’s service, tailoring recommendations to interests, and making the Service easier to use. Third party advertisers on the Services may also place or read cookies on your browser. Cookies can be disabled at any time by changing your web browser’s options to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions or functionalities of a Service.
16) Links
The Service may contain links to other websites or applications. The fact that the Service links to a website or application or presents a banner ad or other type of advertisement does not mean that Fun Comp endorses or authorizes that third party, nor is it a representation of any affiliation with that third party. If you click on a link to a third party site or application, including on an advertisement, you will leave the Fun Comp site you are visiting or application you are running and will go to the site or application linked to. These third party websites and applications may place their own cookies or other files on your computer or mobile device, and may collect data or solicit personal information from you. Other sites and applications follow different rules regarding the use or disclosure of the personal information you submit to them. Because Fun Comp cannot control the activities of third parties, it cannot accept responsibility for any use of your personal information by such third parties, and it cannot guarantee that they will adhere to the same privacy and security practices as Fun Comp. You are therefore encouraged to read the privacy policies or statements of other websites and applications you visit before providing any personal information.
17) Changing or Deleting Your Information
You may review, update, correct or delete certain personal information by changing the applicable information in your profile page. If you completely delete all of this information, your account may be deactivated.
If you choose to delete or close your account, you must withdraw you entire withdrawable balance. Some or all funds remaining in your account will be forfeited after 7 days if you do not request in writing for your withdrawable balance to be mailed to you. You agree to additional processing fees of $30 US or 10% (whichever is greater) if Fun Comp has to process any payment via check and to provide additional identification and mailing address information to confirm payment is being mailed to the correct person. If you want to withdraw funds from your account before closing it, you must request to do so prior to terminating your account. If Fun Comp unilaterally close or terminate your account due to your violation (as determined in our sole discretion) of these Terms, funds in your account may be forfeited as a penalty to you and not returned to you.
If you would like Fun Comp to delete your record in its system, please contact Fun Comp at fclegalattention@funcomp.com and it will attempt to accommodate your request and you acknowledge that Fun Comp may have to retain certain records for legal or internal purposes.
18) Security
Fun Comp has made reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, Fun Comp cannot guarantee that unauthorized third parties will never be able to overcome those measures or use your personal information for improper purposes. Also please note that email and messaging systems are not considered secure, so Fun Comp discourages you from sending Fun Comp personal information through these media.
19) Policy Regarding Persons Under 18
This product is intended for use by those 18 or older for amusement purposes only. We do not knowingly collect personal information from people under the age of 18. If Fun Comp learns that a person under the age of 18 has provided it with personal information, Fun Comp may take steps to delete such information and the account as soon as possible.
20) Payments
For Fun Comp’s policy regarding the purchase of “Entry”, “Games”, "Contest", "Tournament", “Tickets”, “Seats”, "Sales", “Coins”, "Gifts" or other products or virtual currency, please see Fun Comp’s Terms of Service.
21) Jurisdiction Liability Waiver
All named and unnamed countries within this contract may have full or partial restrictions of our Services at the time of the most recent draft of our Terms and you agree to not hold Fun Comp or it’s partners liable for any current or future legal restrictions or violations known or unknown by Fun Comp or its partners.
